Article 40.2 of the CE establishes the right of workers to periodic paid leave. However, due to its location in the constitutional text, it is not a fundamental right, directly enforceable and applicable, but a guiding principle of social and economic policy that needs legal development in order to be applicable. This legal development is specifically art. 38 of the ET, which provides that the period of paid annual leave will be the one established in the collective agreement or in the individual contract and, in no case, will be less than 30 calendar days.
